My Central A/c And Furnace Are Too Small To Properly Heat And Cool My Apt. Can I Break Hud Section 8 Lease?

because of this? without losing my assistance? A repairman told my landlord is was inadequate for this size of apartment, I don’t believe he is going to replace the unit. I moved in in Feb and it was freezing with the furnace on (it pretty much ran non-stop, and I only like the heat at about 65 in the winter) and now when it’s 85 out and I run the a/c it’s usually like 90 in here. I just don’t know what to do. I start school in the fall and really need the assistance. Does anyone know anything about this? Thanks!

    You can not break the lease without losing your section 8 subsidy. You have a roof over your head, and you are not paying for it. You are not satisfied with the condition of the apartment, and want to move to something nicer, again using other people’s money. Rather than starting school in the fall, why not start working two jobs so that you are not leaching off of hard working taxpayers?
    Get a fan for the summer and a portable heater for the winter. Until you are paying, you should be grateful for having a place to live.

    Get a job, earn your own money, pay your own way and you can get what you want. As long as you want to keep your assistance, you have to live with what you can get by someone else’s rules. You cannot break your lease and keep your assistance. Buy a fan heater – use the fan in summer, heater in winter to augment what you’ve got. No landlord accepting Sec 8 can afford to buy a bigger, more powerful furnace & AC system. Sec 8 properties are cheap, and cheaply run.

    sound like th ewireing is fouled up…
    in a friends house who has/had a similar issue (running poorly) the returns were insuficient to cycle the air back to the unit. maybe check this. i asked a hvac man and was told the area of inlets and outls need to be equal as a simple rule of thumb…

    NO. you WILL lose your assistance. You need to notify both HUD and the Land Lord in writting. If no action is taken, then you can talk to hud about moving to another location. Also, check your state laws regarding tenants rights.
